Terms of Use

1. Agreement
These Terms of Use form an agreement between the person or organisation using FinlyOS and Fintech Accounting Services (Pty) Ltd, trading as Finly. Finly is our trading name and FinlyOS is the branded service covered by these terms.
In these terms, “Finly”, “we”, “us”, and “our” refer to Fintech Accounting Services (Pty) Ltd. By accessing the service, you confirm that you have authority to accept these terms for yourself and, where applicable, your organisation.
2. The service
FinlyOS connects authorised accounting data sources and produces dashboards, analytical summaries, and management reports. Features may evolve as providers change their services or as Finly improves the platform.
3. Authorised use
You may use the service only for lawful business and accounting purposes. You must have permission to access every company and data source you connect. You are responsible for safeguarding your account, reviewing user access, and promptly notifying us of suspected unauthorised use.
You must not attempt to bypass security controls, disrupt the service, introduce malicious code, access another customer's information, or use provider data in breach of the provider's terms.
4. Accounting data and reports
You retain ownership of information submitted to or obtained through your authorised accounting connections. You grant Finly the limited right to process that information solely to operate and support the service.
Reports are decision-support tools and may depend on the completeness, timing, and classification of source data. They do not replace professional accounting, tax, legal, investment, or audit advice. You remain responsible for reviewing and approving reports before relying on or distributing them.
5. Third-party services
The service may integrate with QuickBooks Online, Xero, Zoho Books, Sage, Google Drive, and other third-party services through approved application programming interfaces (APIs). Your use of those services remains subject to their own agreements, permissions, subscription plans, and availability. Finly is not responsible for outages, data errors, access restrictions, or changes controlled by a third-party provider.
6. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. We may perform maintenance, correct faults, change features, or suspend access where reasonably necessary for security, legal compliance, or protection of the service.
7. Confidentiality and privacy
Each party must protect the other party's confidential information and use it only for the agreed purpose. Our handling of personal information is described in the Privacy Policy.
8. Liability
To the extent permitted by law, Finly is not liable for indirect, incidental, special, or consequential loss, loss of profit, or loss caused by inaccurate or incomplete source data, third-party services, or decisions made from an unreviewed report. Nothing in these terms excludes liability that cannot lawfully be excluded.
9. Suspension and termination
You may stop using the service and disconnect an accounting provider at any time. Finly may suspend or terminate access for material breach, unlawful activity, non-payment under an applicable service agreement, or a security risk. Upon termination, data is handled according to the Privacy Policy and applicable legal requirements.
10. Governing law and contact
These terms are governed by the laws of South Africa. FinlyOS is operated by Fintech Accounting Services (Pty) Ltd, trading as Finly. Questions about these terms may be sent to support@finly.co.za.
